BRISBANE, Feb 3 AAP - One of Australia's biggest construction companies is being taken
to court over the death of a worker at a central Queensland coal terminal.

Comcare, Australia's workplace safety agency, initiated proceedings in the Brisbane
Federal Court on Tuesday against John Holland Pty Ltd over the death of a worker from
Grasstree Beach, south of Mackay, on May 6 last year.

FED:Four million Aussies riding bikes weekly

A survey that's found almost five million Australians ride bikes each week will form
a critical baseline in efforts to increase cycling in the next five years.

The national survey of 25-thousand people between March and April found 1.2 million
people cycle to work, while another 3.6 million cycle for recreation in an average week.

The survey, conducted by Sinclair Knight Merz for the Australian Bicycle Council, found
Victoria was Australia's most active cycling state, while NSW has the lowest participation
rate.

Bicycle Network chief executive HARRY BARBER says the survey shows adults who ride
are on average getting all the physical activity they need for good health, but young
people are only getting half.

The network wants to double participation in cycling by Australians between 2011 and 2016.

SHENZHEN, Mar 01, 2011 (SinoCast Daily Business Beat via COMTEX) -- It has been ten years since 2001, when Huawei Technologies Co., Ltd. forayed into the North American market. Under the pressure of the US government, the Chinese leading telecommunications equipment supplier lately announced to give up the acquisition of 3Leaf Systems.

In May 2010, Huawei spent USD 2 million in acquiring partial assets from 3Leaf. In November 2010, the former submitted the deal to the Committee on Foreign Investment in the United States (CFIUS).

On February 11, 2011, Huawei received a notice from the US government regulator, suggesting the company to withdraw its application for acquiring partial assets from 3Leaf, which was then turned down by the applicant.

According to the regulation of the US, if Huawei refuses to accept the advice, President Barack Obama will make a final ruling within 15 days. Then, five representatives jointly sent a letter to the US government, claiming that the acquisition of Huawei will threaten the country's computer network.

On February 19, Huawei released a statement, saying that it had made a hard decision to accept the advice of the CFIUS and withdraw its application to acquire partial assets from 3Leaf.

Actually, as early as March 2008, Huawei finally gave up the acquisition of 3Com jointly with Bain Capital, which had not passed the examination of the CFIUS as well. Dozens of US representatives and government officials worried that the deal would give Huawei access to the country's military technology.

Usually, Huawei will remain silent to the abjuration of mergers and acquisitions. However, on February 25, many Internet users saw an open letter from the company's vice chairman Ken Hu, enumerating misunderstanding Huawei encountered in the US in the past ten years.

In the letter, the top management of Huawei hopes that the US government could launch investigations into the company to clarify all the doubts. This time, Huawei does not choose to remain silent.

It seems that Huawei is also thinking back to the things that have happened. A top executive of the company points out that they will improve their service, products and public relations in North America next.

In recent years, Huawei and its domestic peer ZTE Corporation (SEHK: 0763 and SZSE: 000063) swept away all obstacles in Europe, Asia, Africa and Latin America. However, they met accidents in North America.

For a long time, Alcatel-Lucent (NYSE: ALU), Nortel Networks Corporation (NYSE: NT) and Motorola Inc. (NYSE: MOT) have been dominating the communications equipment market of North America.

However, Huawei has so far set up 13 offices and eight R&D centers in the region. In the past ten years, its investment in research and development jumped by 66% in the US each year and reached USD 62 million in 2010.

HOBART, April 27 AAP - A man has been found not guilty of murdering Chinese student
Zhang "Tina" Yu, but guilty of her manslaughter.

Daniel Williams, 22, of Kingston, south of Hobart, pleaded not guilty to murdering
the 27-year-old accounting student on June 25 last year.

His co-accused, Stavros Papadopoulos, 22, pleaded guilty in March to murdering Ms Yu,
and will be sentenced next month.

Papadopoulos has admitted using a concrete brick to bludgeon her, before punching,
strangling her and drowning her at a unit in the Hobart suburb of New Town.

Her body was dumped in the Tyenna Rivera, 60km west of Hobart.

Williams said he acted out of fear that he would be Papadopolous' next victim.

The jury of seven men and five women took more than a day to reach their verdict, delivering
it shortly before 5pm (AEST) on Wednesday.

Justice David Porter remanded Williams in custody until May 10.

SYDNEY, Dec 15 AAP - Prince William's visit to NSW next month will be an opportunity
to showcase the state in foreign media, Premier Kristina Keneally says.

Ms Keneally on Tuesday confirmed the prince would officially visit NSW in late-January
as part of his first Australian trip as an adult.

He previously travelled Down Under with his parents, Prince Charles and Princess Diana,
a year after his birth in 1983.

The second in line to the British throne will be in Sydney and Melbourne from January
19-21, spending the first two days of the trip in NSW.

Ms Keneally, who will host the prince on January 20, said details of the visit were
yet to be made public.

However, it's expected the prince will be accompanied by a large contingent of British
journalists, covering his first major Australian visit.

The trip could have even greater media focus if he travels with long-time girlfriend
Kate Middleton, with rumours they may announce their engagement over the Christmas period.

"Prince William's visit will showcase NSW to an international audience," Ms Keneally
said in a statement on Tuesday.

"We are delighted to welcome back the prince to Sydney."

Buckingham Palace was expected to soon release the prince's program, she said.

The Office of the Prime Minister says the visit originated from Prince William's request
to visit the country to get to know Australia and its people.

"During his visit, Prince William will focus on his core interests of supporting servicemen
and women, helping young people fulfil their potential and sustainable development in
the light of climate change," it has said.

"The prince will also use the visit to learn more about local indigenous issues and
visit the bushfire-ravaged countryside in Victoria," it has said.

"Prince William will have the opportunity to meet a cross-section of Australians involved
in a variety of projects of interest in both Sydney and Melbourne."

He will be arriving after a visit to New Zealand, where he will be opening the new
Supreme Court in Wellington.

Bolt posed for pictures with a 13-year-old girl who lost both legs in the May 12 quake

BEIJING - The 2008 Olympics drew an estimated television audience of 4.4 billion in
the first 10 days, setting a new viewing record for an Olympic Games.

Market research company Nielsen says the estimated audience from August 8-17 surpassed

watched the Sydney Olympics four years earlier.

BEIJING - Olympic host city Beijing hasn't ruled out making controversial car use limits
permanent, citing the benefits for the environment.

The China Daily quotes an official as saying there are no concrete plans to extend
the rule, which has taken at least a million cars off the streets of the capital city,
but it is worthy of consideration.

"The rule is closely related to everyone's daily life. We want to hear more public
opinion on the whether, or how, to keep the rule," said Wang Li, deputy director of Beijing's
traffic administration bureau.

SYDNEY, Dec 14 AAP - A Sydney company will offer free whale watching trips to visiting
Japanese as part of a campaign against their country's whale slaughter.

Whale Watching Sydney says it hopes to raise Japanese people's awareness of the importance
of protecting whales through close encounters with the giant mammals.

The tour operator will give free cruises next year to anyone with a Japanese passport.

The company's manager, Will Ford, said Japanese who took advantage of the offer would
be educated about Australians' love of whales and their objections to the whaling industry.

"It seems like they don't really have a good idea ... so hopefully the idea is to sort
of break through that and show them what is worth being protected," Mr Ford said.

"Hopefully it tips the balance and stops the whaling ... even if it doesn't do it in
2008 and it does it (the) next year, then it will be well worth the cost and the involvement."

Mr Ford said very few tourists favoured whale hunting once they saw the mammals in the wild.

"There are very few people who come out and do a whale-watching cruise and then go
away thinking that it's still okay to eat them or to hunt them," he said.

Mr Ford said he hoped other whale watching cruise companies would introduce similar deals.

Whale Watching Sydney cruises are normally priced at $80 for an adult.

NSW: Six houses evacuated during grass fire south of Wollongong

SYDNEY, Aug 3 AAP - Six houses were evacuated after a grass fire swept through the
suburb of Warrawong south of Wollongong.

The fire destroyed five hectares of grassland and threatened property south west of
Port Kembla Hospital about 9.15pm (AEST) last night, a NSW Fire Brigades spokesman said.

"There were six properties under threat but the fire was all contained between Vermont
Rd and Little Place and the property was protected," the spokesman said.

The fire was extinguished by 10.50pm (AEST) and residents were allowed to return to their homes.

A man convicted of murdering Sydney policeman GLENN MCENALLAY .. despite not firing
the fatal shot .. is appealing the severity of his sentence.

In September 2003 JOHN TAUFAHEMA was found guilty of murdering Senior Constable MCENALLAY
.. who was shot after pursuing a stolen car at Hillsdale .. in Sydney's south-east ..

in March 2002.

JOHN TAUFAHEMA pleaded guilty to using an offensive weapon to prevent lawful apprehension
.. attempted carjacking and unauthorised use of a firearm.

But he was also found guilty of murder because it was agrued he'd been involved in
a joint criminal enterprise.

He was sentenced to 24 years' jail with a non-parole period of 17 years.

In the Criminal Court of Appeal his barrister .. TIMOTHY GAME .. has argued TAUFAHEMA
couldn't have been part of a joint criminal enterprise because he couldn't have foreseen
the policeman might be killed during the incident.

He says his client ran away before the gunman even pulled the trigger.

But Crown Prosecutor DAVID FREARSON has described the killing as a deliberate and vicious
shooting murder .. and says the judge's directions to the jury over the matter were appropriate.

Justices PETER MCCLELLAN .. CAROLYN SIMPSON and DEREK PRICE reserved their decision.







Also in the car .. which was being driven by TAUFAHEMA's brother MOTEKIAI .. were SIONE
PENISINI and MELI LAGI and four loaded stolen guns.

The men tried to evade Constable MCENALLAY .. but when the car struck a gutter and
stopped .. PENISINI got out and fired at the 26-year-old policeman.

He was hit four times and died in hospital from head and chest wounds.

MOTEKIAI TAUFAHEMA was convicted of murder but successfully appealed his conviction.

Qld: Howard a reminder of disunity, says Beattie

BRISBANE, Aug 23 AAP - Queensland Premier Peter Beattie has warned Prime Minister John
Howard his intervention in the state's election campaign could help Labor win a fourth
successive term.

Mr Howard said today he had accepted an invitation from Opposition Leader Lawrence
Springborg to attend the coalition's campaign launch in Brisbane on September 3.

"I'll be telling the voters that the Beattie government has failed the people of Queensland
in crucial areas like health," Mr Howard told reporters in his first foray into the campaign
for the September 9 poll.

But Mr Beattie said Mr Howard's presence would be a reminder of the failed attempt
this year by Queensland's Nationals and Liberals to form a united conservative party.

"I can remember Mr Springborg attacking the prime minister for getting involved when
there was a move to get one united conservative party," Mr Beattie told AAP.

"I always welcome the prime minister to Queensland as long as he brings money.

"But his appearance will remind people that there was an attempt to get one united
conservative party and the prime minister made sure it didn't happen and Mr Springborg
attacked him.

"So I'm happy to have that reminder because it just shows that there's only one strong
stable government to provide certainty."

Federal Opposition Leader Kim Beazley will also join the campaign tomorrow when he visits Cairns.

Although he's expected to be at Labor's campaign launch, Mr Beazley said Mr Beattie
wouldn't need much help from him in the lead-up to the election.

"I'll be dealing with industrial relations and education issues while I'm up there,"

he told reporters in Sydney.

"Peter Beattie strikes me as the sort of bloke who's conducting a very fine campaign on his own."

Mr Howard said the Queensland election would be determined on state issues.

"I'll be going up for the day of the launch and I'll do what I'm asked to do," Mr Howard
told reporters on the NSW Central Coast.

Queensland has been a happy hunting ground federally for Mr Howard, but the coalition
has struggled at state level and polls and betting markets are pointing to a comfortable
Labor win.

"There are a lot of people who vote for John Howard at a federal level and vote for
my government at a state level,' Mr Beattie said on the campaign trail at Chinchilla,
west of Brisbane.

"They have shown impeccable judgment in the past and I'm hopeful that I can convince
them to continue to show that level of judgment in the next state election as well."

PERTH, April 17 AAP - Federal health authorities have been "unreceptive" to concerns
about an evolving epidemic of new strains of golden staph, a senior public health official
says.

Dr Keryn Christiansen, of Royal Perth Hospital (RPH), says community acquired methicillan
resistant staphylococcus aureus, or CA-MRSA, is increasing for unknown reasons in some
parts of Australia and particularly Western Australia.

Dr Christiansen and co-authors of a study published in this month's Australian Medical
Journal, surveyed 2,600 golden staph isolates (germs) collected from around Australia.

Nationally, the appearance of the CA-MRSA strain rose from 4.7 per cent to 7.3 per
cent of the sample, compared with similar surveys in 2000 and 2002.

WA had a quarter of all national cases of CA-MRSA, between July 2004 and February 2005.

The article refers to the issue as an "evolving epidemic".

But Dr Christiansen, head of microbiology and infectious diseases at RPH, says she
has had trouble drawing the issue to the attention of federal authorities.

"Unfortunately we've been unable to engage the federal government in this," she told AAP.

"They've got other things on their agenda like pandemic flu and bio-terrorism and they're
really putting a lot of money into that and not looking at this."

Methicillin-resistant Staphylococcus (MRSA), or Golden Staph, has long plagued hospital
patients but other virulent related strains are now infecting people who have had no hospital
contact.

"In the past when we've seen the resistant strains, we've seen them in hospitals and
they've been resistant to many, many antibiotics," said Dr Christiansen.

"What we're seeing now is something completely different.

"These patients have had no contact with hospitals, have never acquired these organisms
from hospital contact and when you look at the organism genetically, they are quite distinct
from the hospital variety.

"Our other concern is that some of these strains contain a toxin called Panton-Valentine
leukocidin (PVL), and this toxin actually breaks down white blood cells."

Dr Christiansen said they were not sure why the number of cases in WA was so high,
but the state had a rigorous reporting process, not in place in other states and territories.

"Every single MRSA that's isolated in this state is notified and we collect at my lab
- we actually get the organism and we test it," she said.

"We're not really sure why they should be so high ... we've got a few studies going
to try and look at reasons for our high rates.

"Our concern is that it is becoming more and more resistant and therefore will be difficult
to treat," Dr Christiansen said.

Symptoms of community-acquired MRSA could be sores that turned into large abscesses

Fed: Boswell should "retire gracefully"

CANBERRA, Dec 19 AAP - Veteran Nationals Senate leader Ron Boswell is facing calls
from within his own party to quit politics and make way for a new generation of senators.

Senator Boswell, who turned 65 this month, announced at the weekend he would seek another
six-year term at the next federal election, due in 2007.

Preselection closes at the end of February, with the Nationals' central council due
to decide on who will head the party's senate ticket by the middle of next year.

But the party's deputy leader in Queensland, Jeff Seeney, today said it was time for
Senator Boswell to go.

"I personally would have been very pleased to see Ron retire gracefully," he told ABC radio.

"And I think a very significant number of people in the National party would like to
have seen Ron acknowledge that he had a long career and to retire gracefully at this point
and allow the next generation of senators to take their place."

Mr Seeney said there had been a change in the Nationals, inspired by Queensland Senator
Barnaby Joyce's defiance of the Liberal Party by voting against the government's voluntary
student unionism (VSU) legislation and its trade practices law reforms.

"I think there's very strong support for the new style of senator that Barnaby Joyce
has displayed in Canberra," he said.

"We've always had to go out and negotiate with what is a poor compromise for us, and
a poor compromise that's forced upon us by the Liberal Party in many instances."

There is believed to be widespread concern in the Queensland Nationals about what many
in the party see as Senator Joyce's shabby treatment in Canberra.

Senator Boswell publicly criticised Senator Joyce's vote against VSU as populist earlier
this month.

While Senator Joyce hit back and branded the criticism as an unnecessarily personal
attack, today he refused to predict Senator Boswell's future.

"It will be a Melbourne Cup field of good candidates because of the profile of the
National party senate position," Senator Joyce told AAP.

"I just hope that people just accept the outcome and move on."

He would not say whether he thought Senator Boswell would have the numbers to win.

"You never know," he said.

"There's never ever a vote in the bag. As soon as you think that, you've just come second."

While steering clear of a direct attack on his colleague, Senator Joyce offered only
limited praise of Senator Boswell, saying he had been an effective advocate for Queensland
"at times".

Senator Joyce's friend, former journalist and senior Nationals staffer James Baker,
has also nominated for the senate ticket and is expected to be a frontrunner.

But Senator Joyce said reports of his "raving endorsement" of Mr Baker had been exaggerated
and the best candidate would win preselection.

Federal Nationals MP Bruce Scott, who is also the party's Queensland president, refused
to buy into the debate about Senator Boswell's future.

"It's just not appropriate for me as president to be becoming a political commentator
on this issue," he told AAP.

"Everyone has the right to nominate for a position on the National party ticket."

Ron Boswell was first elected to the Senate in 1983 and has been the Nationals' senate
leader since 1990.

He could not be contacted for comment today.
